COVID-19 pandemic “probably not” a Barder event and varying executory orders is questionable (Family Court)

In BT v CU [2021] EWFC 87, Mostyn J held that the COVID-19 pandemic is “probably not” a Barder event, but each case will be fact-dependent. He also postulated that the Thwaite jurisdiction, providing that an executory order can be varied, has been misapplied in recent cases.
